Welcome to EffDel, a grocery delivery platform that operates our own stores and connects customers with delivery partners. These Terms and Conditions ("Terms") constitute a legally binding agreement between you and Effdel Enterprise Private Limited ("EffDel", "Company", "we", "us", or "our") regarding your use of our website located at https://effdel.com and our mobile application (collectively, the "Platform").

By accessing or using our Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Platform.

For the purposes of these Terms, the following definitions apply:

• "Platform": The EffDel website and mobile application
• "User": Any individual accessing or using the Platform
• "Merchant": EffDel's own grocery stores and inventory managed by the Company
• "Delivery Partner": Individuals or entities responsible for delivering orders to Users
• "Services": All services offered through the Platform, including but not limited to grocery ordering and delivery
• "Content": All information, data, text, software, music, sound, photographs, graphics, video, messages, or other materials

EffDel does not sell, distribute, or deliver the following restricted products:

• Alcohol and alcoholic beverages
• Tobacco products and smoking accessories
• All medicines, prescription medications, and pharmaceutical products
• Controlled substances

By using our Platform, you acknowledge and agree that these products are not available for purchase through EffDel.

4.1 Eligibility

You must be at least 13 years old to use the Platform. By using the Platform, you represent and warrant that you are at least 13 years of age and have the legal capacity to enter into this agreement.

4.2 Account Registration

To place orders, you may need to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

4.3 User Responsibilities

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use of your account
• Ensuring that your use of the Platform complies with all applicable laws

5.1 Order Placement

By placing an order, you agree to purchase the selected items from EffDel's inventory. All orders are subject to acceptance by EffDel and availability of items in our stores.

5.2 Pricing

Prices displayed on the Platform are determined by us and may include applicable taxes and delivery charges. Prices are subject to change without notice. We reserve the right to correct any pricing errors.

5.3 Payment

Payments can be made through various methods provided on the Platform, including credit/debit cards, UPI, digital wallets, and UPI on delivery. EffDel is not responsible for any payment-related issues arising from third-party payment gateways.

5.4 Payment Authorization

By providing payment information, you authorize us to charge the specified amount for your order. If payment cannot be processed, your order may be cancelled.

6.1 Delivery Partners

EffDel connects Users with Delivery Partners for order fulfillment. Delivery Partners are independent contractors and not employees of EffDel.

6.2 Delivery Time

Estimated delivery times are provided for convenience and may vary due to factors beyond our control, including traffic conditions, weather, and order volume.

6.3 Delivery Address

You are responsible for providing accurate delivery addresses. EffDel is not liable for delivery failures due to incorrect addresses provided by Users.

6.4 Non-Delivery

In case of non-delivery, please contact our customer support for assistance. We will work to resolve delivery issues promptly.

7.1 Cancellation by User

Once an order is placed through the Platform, it cannot be cancelled by the User. All orders are final and binding upon placement. This policy ensures efficient order processing and delivery operations.

7.2 Cancellation by EffDel

We reserve the right to cancel orders due to unforeseen circumstances, including but not limited to:

• Unavailability of items
• Technical issues
• Weather conditions
• Force majeure events

7.3 Refunds

Refunds will only be issued under the following specific conditions:

• Products received in damaged condition
• Products received past their expiration date
• Orders cancelled by EffDel due to circumstances listed in Section 7.2
• Technical errors in pricing or order processing

All refund requests must be reported within 24 hours of delivery and will be subject to verification. Refund processing times may vary depending on the payment method used.

8.1 General Terms

EffDel may, at its discretion, offer promotional discounts, coupon codes, or special offers to users. The following terms apply to all promotional offers and coupons:

Promotional offers are available to users who meet the specified criteria for each promotion. To redeem a coupon, users must enter the provided code at checkout. Each coupon is valid for a single use per user unless stated otherwise.

8.3 Validity Period

Coupons are valid from the start date until the expiration date specified in the promotion. Expired coupons will not be accepted. Users are responsible for ensuring coupons are used within the validity period.

8.4 Usage Limitations

Each coupon may have specific limitations including:

• One-time use per user restrictions

8.5 Combining Offers

Unless explicitly stated, coupons cannot be combined with other promotions, discounts, or offers. Only one promotional offer can be applied per order.

8.8 Misuse and Fraud

Any misuse of coupons or fraudulent activities may result in:

• Order cancellation
• Account suspension or termination
• Legal action
• Blacklisting from future promotions

8.9 Refunds and Coupons

If an order using a coupon is cancelled or refunded, the coupon value will be forfeited and cannot be reused. Refunds will be processed based on the actual amount paid after coupon discount.

8.10 Transferability

Coupons are non-transferable and cannot be sold, traded, or transferred to other users. They are linked to the specific user account and cannot be shared.

9.1 Prohibited Activities

Users must not engage in activities that are:

• Illegal, fraudulent, or harmful to the Platform or other Users
• In violation of any applicable laws or regulations
• Intended to disrupt or damage the Platform
• Involving harassment, abuse, or threatening behavior

9.2 Reviews and Feedback

Users may provide reviews and feedback, but must not post false, misleading, defamatory, or inappropriate content. We reserve the right to remove such content.

9.3 Account Suspension

We may suspend or terminate accounts that violate these Terms or engage in prohibited activities.

10.1 Ownership

All content on the Platform, including logos, trademarks, text, graphics, and software, is owned by EffDel or its licensors and is protected by intellectual property laws.

10.2 Restrictions

Users may not:

• Use, reproduce, or distribute any content without prior written permission
• Modify, adapt, or create derivative works from the Platform
• Reverse engineer or attempt to extract source code
• Use automated systems to access the Platform

To the maximum extent permitted by law, EffDel shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, data, or business opportunities
• Service interruptions or delays
• Third-party actions or omissions
• Force majeure events

Our total liability shall not exceed the amount paid by you for the specific order in question.

You agree to indemnify and hold harmless EffDel, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from:

• Your use of the Platform
• Your violation of these Terms
• Your violation of any third-party rights
• Your violation of applicable laws

We reserve the right to suspend or terminate your access to the Platform at our discretion, without notice, for conduct that we believe:

• Violates these Terms
• Is harmful to other Users or us
• Exposes us to legal liability
• Disrupts the Platform's operation

You may terminate your account at any time by contacting our customer support.

These Terms are governed by the laws of India. Any disputes arising from or relating to these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts in Hyderabad, Telangana, India.

EffDel reserves the right to modify these Terms at any time. We will notify Users of significant changes through the Platform or via email. Continued use of the Platform after changes indicates acceptance of the new Terms.

It is your responsibility to review these Terms periodically for any updates.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and EffDel regarding your use of the Platform.
